Terms of Use
Our Programs, Products, and Services are owned and operated by Stressed Out Humans LLC. (“Company”, “we”, or “us”, or "I"). The term “you” refers to any purchaser and/or user of any of our Programs, Products and/or Services.
These Terms of Use for Programs, Products, and Services (“Terms of Use”) state how you may use our Programs, Products and Services and Program Materials, and their content. Please read these Terms of Use carefully. We reserve the right to change these Terms of Use from time to time.Â
By using any of our Programs, Products and Services you are agreeing to the Terms of Use as they appear and are legally bound by them, whether or not you have read them. If at any time you do not agree with these Terms of Use, please do not use our Programs, Products and Services.
These Terms of Use require the use of arbitration on an individual basis to resolve disputes, rather than jury trials, and limit the remedies available to you in the event of a dispute. You fully understand and agree that by enrolling in, purchasing and/or using any of our Programs, Products, Services and Program Materials that you are waiving certain legal rights and you are voluntarily agreeing to do so.
Scheduling and Timing
Scheduling Appointments: Should you need to reach me between appointments, please contact via email. I will do my best to respond to you within 24 hours on weekdays. On weekends and holidays, I will do my best to reply to you by the next business day. When you send e-mails, I ask that you be as clear as possible about the kind of support you need. If you want to discuss something at length with me, I may request that we wait and discuss your question at our next appointment. Please come prepared to start and end your appointments on time.
Rescheduling:Â If you need to reschedule a session, you need to do so at least 24 hours in advance of your scheduled time by sending an e-mail or rescheduling via my scheduling system, Appointlet via the reschedule link you receive when booking the initial appointment. If I need to reschedule a session, I will also contact you via Email or text at least 24 hours before our scheduled session.
Cancellation: Â If you need to cancel your appointment, you need to do so at least 24 hours in advance of your scheduled time by sending an e-mail or rescheduling via my scheduling system, Appointlet via the reschedule link you receive when booking the initial appointment as long as you give notice you can reschedule your appointment. If you do not contact me at least 24 hours in advance you will be charged for your appointment.Â
Expectations
During the Program, you can expect that I will:

Devote my full attention to you during our time together.

Serve as your accountability partner and supporter.

Stretch you outside of your comfort zone.

Offer support, encouragement, feedback and guidance.
I expect that you will:

Show up on time without distractions.

Give 100% of your effort and fully commit to the Program.

Come fully prepared for our time together.

Use your best efforts to complete all action steps.

Promptly provide payment for the Program.

Be open to new ideas and willing to stretch and grow.

Ask any questions you may have as they arise.
Investment and Payment
All payments made through Kajabi/Stripe are subject to a 2.9% service. If using the payment plan, you will be auto-debited for your session fee monthly via Kajabi/Stripe, in advance of the next month’s coaching. You may also pay in person with a check to avoid the 2.9% service fee if added. Your fees are payable upon receipt.Â
You agree that you are financially willing and able to invest in this Program by choice, and that by so doing, you are not incurring any economic hardship in any way.

If paying in full, your investment must be made upon enrollment in the Program.

If paying monthly, payment of the first installment must be made upon enrollment in the Program, and all subsequent monthly payments in the amount will be auto drafted in one month increments from the date of the first payment. Â
Payment Authorization and Receipt: If paying by Kajabi, debit card, or credit card, you give us permission to automatically charge your credit card or debit card as payment for your Program without any additional authorization, and you will receive an electronic receipt. If I choose to provide you with a Paypal/Stripe invoice instead, you are required to manually pay it by the date due on the invoice or your Program will be put on hold until payment is made.
Missed Payment: If payment is not received by the date due or there is a problem with the payment transaction or method, you will be notified by e-mail and then have a 3 day grace period to make the payment following the due date, otherwise your Program will be put on hold. If no payment is made within the 3 day grace period, the Program will automatically terminate and you will no longer be granted access. Â
Deposit: Your first payment is considered your deposit if not paying in full.
Refund Policy:Â
Your satisfaction with your Program, Product or Service is important to us. Yet, because of the extensive time, effort, preparation and care that goes into creating and/or providing our Programs, Products, Services and Program Materials offers no refunds under any circumstance.Because this program is offered with immediate access and digital products cannot be returned, when you invest in we ask you invest with confidence and commit to yourself to complete the program.
Refund policy for any 1-on-1 Coaching Services and Yoga Therapy Program:Â
It is my intention for you to be happy with your Program and am always willing to have conversations about payment plans. However, because I have invested considerable time and effort in all my programs, I offer no refunds for one on one coaching or Yoga Therapy Programming. This includes deposits, programs paid in full and payment plans. If you decide to withdraw after one session for any reason, you are still fully responsible for making all Program payments.
Refund Policy for Retreats and Programs:
Your satisfaction with your Program, Product or Service is important to us. Yet, because of the extensive time, effort, preparation and care that goes into creating digital products and/or providing our Programs, Products, Services and Program Materials, we offer no refunds.
We trust that you understand the refund policy, and once you commit to the program you understand you are required to pay it in full.
Refund Policy for Therapeutic Living Membership:
Membership is a subscription that can be canceled at any time. Once you make a payment, it is nonrefundable and you have access to the program for the length of time you selected. You are under no obligation to remain on a recurring subscription plan if you choose to exit the membership and can cancel the next payment inside Kajabi. Once you cancel you no longer have access to any of the materials, workshops and content inside the membership.
By using and/or purchasing any of our Programs, Products, Services or Program Materials, you understand and agree that all sales are final.
Intellectual Property Rights
I retain all ownership and intellectual property rights to the Program content and materials provided to you through the Program, including all copyrights and any trademarks belonging to me. The Program content and materials are being provided to you for your individual use only and with a single-user license which means that you are not allowed or authorized to share, copy, sell, post, distribute, reproduce, duplicate, trade, resell, exploit, or otherwise disseminate any portion of the Program or Program materials, electronically or otherwise, for business or commercial use, or in any other way that earns you money, without my prior written permission.Â
If you choose to use the content in ways that we do not specifically give you written permission, you agree now that you will be treated as if you had copied, duplicated and/or stolen such Content from us, and you consent to immediately stop using such Content and to take whatever actions as we may request and by the methods and in the time frame that we prescribe to protect our intellectual property and ownership rights in our Programs, Products, Services or Program Materials.
Personal Responsibility & Assumption of Risk: You acknowledge that you take full responsibility for yourself and all decisions made before, during and after your Program. You accept full responsibility for your choices, actions and results before, during and after this Program, and you knowingly assume all of the risks of the Program related to your use, misuse, or non-use of the Program or any of the Program materials. You understand and agree that you are solely responsible for your results.
Limitation of Liability, Indemnification, and Release of Claims:Â I will not be held responsible in any way for the information that you request or receive through this Program, including my services, products, and Program materials and any other information you have received from or through me related to this Program. You agree that you fully and completely hold harmless, indemnify and release me from any and all liability, damages, causes of action, allegations, suits, sums of money, claims and demands whatsoever, in law or equity, that you ever had, now have or may have against me in the future that may arise from your participation in the Program, including all services, products, and Program Materials, to the extent permitted by applicable law.
Disclaimer: Our Programs, Products, Services, and Program Materials are for informational and educational purposes only. To the fullest extent permitted by law, we expressly exclude any liability for any direct, indirect or consequential loss or damage incurred by you or others in connection with our Programs, Products, Services, and Program Materials, including without limitation any liability for any accidents, delays, injuries, harm, loss, damage, death, lost profits, personal or business interruptions, misapplication of information, physical or mental disease, condition or issue, physical, mental, emotional, or spiritual injury or harm, loss of income or revenue, loss of business, loss of profits or contracts, anticipated savings, loss of data, loss of goodwill, wasted time and for any other loss or damage of any kind, however and whether caused by negligence, breach of contract, or otherwise, even if foreseeable. You specifically acknowledge and agree that we are not liable for any defamatory, offensive or illegal conduct of any other Program, Product, Service or Program Materials participant or user, including you.Â
Medical Disclaimer. Our Programs, Products, Services, and Program Materials are not to be perceived as or relied upon in any way as medical advice or mental health advice. Communication Guidelines
If you have a question or concern about your Programs, Products, Services, or Program Materials, you may send an e-mail to [email protected] and we will do our best to reply to your question or concern promptly.
 All information obtained during your purchase or transaction for our Programs, Products and Services and all of the information that you give as part of the transaction, such as your name, address, method of payment, credit card number, and billing information, may be collected by both us and our payment processing company. Per our Privacy Policy, please make sure that you review the privacy policy of our payment processor.
You agree to only purchase goods or services for yourself or for another person for whom you are legally permitted to do so or for whom you have obtained the express consent to provide their name, address, method of payment, credit card number, and billing information.
You agree to be financially responsible for all purchases made by you or someone acting on your behalf. You agree to use our Programs, Products, Services, and Program Materials for legitimate, non-commercial purposes only and not for speculative, false, fraudulent, or illegal purposes.Â
Since we have a clear and explicit Refund Policy in these Terms of Use that you have agreed to prior to completing the purchase of any of our Programs, Products, or Services, we do not tolerate or accept any type of chargeback threat or actual chargeback from your credit card company.Â
In the event that a chargeback is placed on a purchase or we receive a chargeback threat during or after your purchase, we reserve the right to report the incident to all three credit reporting agencies or to any other entity for inclusion in any chargeback database or for listing as a delinquent account which could have a negative impact on your credit report score. The information reported will include your name, email address, order date, order amount, and billing address. Chargeback abusers wishing to be removed from the database shall make the payment for the amount of the chargeback.
We also reserve our right to seek payment from you for any delinquent payment that is not provided by or upon the date due by enlisting the help of a collections agency, and we may exercise our right to report your delinquent payment to all three credit reporting agencies, either directly or through the help of a collections agency.
If you make a purchase from one of our affiliates, or any other individual or company through a link provided on or through our Programs, Products or Services (“Merchant”), all information obtained during your purchase or transaction and all of the information that you give as part of the transaction, such as your credit card number and contact information, may be collected by the merchant and their payment processing company as well. Your participation, correspondence or business dealings with any affiliate, individual or company on or through ourÂ

Dispute Resolution
It is hoped that should we ever have any differences, we could be able to work them out amiably through e-mail correspondence. However, should we be unable to seek resolution within a reasonable time, you agree now that that the only method of legal dispute resolution that will be used is binding arbitration before a single arbitrator, selected jointly, in accordance with the American Arbitration Association Rules. Prior to seeking arbitration, you must send an e-mail to me at [email protected] and include all of your reasons for dissatisfaction with your Program. You understand and agree now that the only remedy that can be awarded to you through arbitration is full refund of your Payment made to date. No other actions or financial awards of consequential damages, or any other type of damages, may be granted to you. We both agree now that the decision of the arbitrator is final and binding, and may be entered as a judgment into any court having the appropriate jurisdiction.Â
By purchasing our Programs, Products or Services you are agreeing to a modification of the statute of limitations such that any arbitration must be begun within one (1) year of the date of your e-mail to me referenced above or you waive the right to seek dispute resolution by arbitration or to take any other legal action.Â
You also agree that should arbitration take place, it will be held in Greene County in the State of Missouri where my business is registered, regardless of the conflict of laws principles, and the prevailing party shall be entitled to all reasonable attorneys’ fees and all costs necessary to enforce the decision of the arbitrator.
In the event of a dispute between us, you agree to not engage in any conduct or communications, including on social media, designed to disparage us, our Company, or any of our Programs, Products or Services. Where requested by law or arbitration, of course, you are not prohibited from sharing your thoughts and opinions as a part of the legal process.
If any terms of these Terms of Use are construed to be invalid or unenforceable for any reason, it shall not affect the validity or enforceability of any other term which shall be given full force and effect.

Viewing by Others. Community Groups
Our Programs, Products and Services may come with access to a community group. These Terms of Use apply to this or other Facebook Groups. Further, you understand that Facebook is a public platform, and therefore, we cannot guarantee your privacy for what you voluntarily share in the group, as other people will also see what you post.
How We Use Cookies
We may use the standard "cookies" feature of major web browsers. We do not set any Confidential Information in cookies, nor do we employ any data-capture mechanisms on our Website other than cookies. Termination
If either of us want to terminate the Agreement at any time, we both agree to notify the other at least 3 days in advance by e-mail. Even after termination by either of us, all of the terms of this Agreement, including all of the Investment, Refund Policy, and Intellectual Property terms, will still apply to both of us now and in the future.

Entire Agreement, Assignment, Survivability and Waiver
This Agreement contains our entire agreement. This Agreement may be modified or amended at any time as long as the amendment is in writing and signed by both of us. You may not assign your rights or obligations under this Agreement to anyone else, and the obligations under this Agreement shall survive indefinitely unless otherwise stated in this Agreement. If I choose to waive or not enforce one or more terms of this Agreement, it does not in any way limit my right to later enforce every part of this Agreement.
Use and Consent
By purchasing or using any of our Programs, Products or Services, you agree to abide by these Terms of Use as well as our Disclaimer, Terms and Conditions and Privacy Policy, and any other terms and conditions that may apply, and are you are required to act in accordance with them. Accessing, purchasing or using our Programs, Products, Services or Program Materials, in any manner constitutes use of the Program, Products, Services and Program Materials, and your agreement to be bound by these Terms of Use.Â
All of our Programs, Products, Services and Program Materials are intended solely for users who are eighteen (18) years of age or older. Any registration by, use of or access to any Program, Product, Service or Program Materials by anyone under age 18 is unauthorized, unlicensed and in violation of these Terms of Use. By accessing or using our Programs, Products, or Services or our Program Materials, you represent and warrant that you are at least 18 years old.
 Your License to Us
By posting or submitting any material on or through our Programs, Products, Services or Program Materials, such as comments, posts, photos, images or videos or other contributions, you are representing that you are the owner of all such materials and you are at least 18 years old.
